1. Acceptance of Terms
By engaging Yireh Business Solutions ("we", "us", "our") for any service โ including web design, SEO, hosting, graphic design, or website maintenance โ you ("the client") agree to these Terms of Service. These terms constitute a binding agreement under South African law.
2. Services
We provide the following services as detailed in our packages at websitedesignjhb.co.za/packages:
- โ Website design and development
- โ Search Engine Optimisation (SEO)
- โ Managed WordPress hosting
- โ Graphic design and branding
- โ Website maintenance and support
The exact scope of services, deliverables, and pricing for each project will be confirmed in a written quote or proposal before work begins.
3. Payment Terms
- โ Once-off projects: A 50% deposit is required before work commences. The remaining 50% is due upon completion before the website goes live.
- โ Monthly services (SEO, hosting): Payment is due monthly in advance. Services will be suspended if payment is not received within 7 days of the due date.
- โ Hourly work: Billed at R750/hour. Invoiced upon completion of work.
- โ All prices are quoted in South African Rand (ZAR) and are exclusive of VAT unless stated otherwise.
4. Project Process & Client Responsibilities
To ensure timely delivery, the client agrees to:
- โ Provide all required content (text, images, logos) within 7 days of project commencement
- โ Provide timely feedback on design mockups (within 5 business days)
- โ Provide necessary access to domains, hosting, and existing accounts as required
- โ Provide written sign-off before the website goes live
Delays caused by the client's failure to provide content or feedback may result in revised timelines and additional charges.
5. Revisions & Changes
Each package includes a reasonable number of revisions as agreed in the project scope. Significant changes to the agreed scope of work after approval will be quoted separately. Additional changes outside the agreed scope are billed at R750/hour.
6. Intellectual Property & Ownership
- โ Upon receipt of full payment, the client owns all custom design elements and content created specifically for their project.
- โ We retain the right to display completed work in our portfolio unless the client requests otherwise in writing.
- โ Third-party assets (stock images, fonts, plugins) remain subject to their respective licences.
- โ The client warrants that all content provided to us does not infringe any third-party rights.
7. Hosting Services
- โ We target 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance may cause brief downtime.
- โ Hosting packages may increase by up to 10% annually. Clients will be notified 30 days in advance.
- โ We are not liable for data loss. While we perform regular backups, clients are encouraged to maintain their own backups.
- โ Hosting will be suspended if payment is overdue by more than 14 days.
8. SEO Services
- โ We do not guarantee specific search engine rankings. SEO results depend on many factors outside our control including Google algorithm changes and competitor activity.
- โ SEO packages may increase by up to 15% annually. Clients will be notified 30 days in advance.
- โ We use only white-hat, Google-compliant SEO practices.
9. Cancellation & Refunds
- โ Once-off projects: The deposit is non-refundable once work has commenced. If the client cancels after work begins, payment is due for work completed to date.
- โ Monthly services: Either party may cancel with 30 days written notice. No refunds for partial months already paid.
- โ Cancellations must be submitted in writing to andre@yireh.co.za.
10. Limitation of Liability
To the maximum extent permitted by South African law, Yireh Business Solutions shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, including loss of revenue, data, or business opportunities. Our total liability in any matter shall not exceed the total fees paid by the client for the specific service giving rise to the claim.
11. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts of Gauteng, South Africa.
